These Terms of Use (“Terms”) form a legally binding agreement between you and Owting LLC (“Owting,” “we,” “us,” or “our”) governing your access to and use of the Owting website, mobile application, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use Owting. By using the Service, you represent that:

  • You are 18 or older

  • You have the legal capacity to enter into this agreement

  • You will comply with these Terms and all applicable laws

We may suspend or terminate accounts that do not meet these requirements.

2. Your Account

To access certain features, you must create an account.

You agree to:

  • Provide accurate information

  • Keep your login credentials secure

  • Be responsible for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Privacy

Your privacy matters to us. We collect, use, and share information as described in our Privacy Policy.

If you are a California resident, you may have rights under the California Consumer Privacy Act (CCPA) and other applicable privacy laws.

By using Owting, you consent to our data practices as outlined in the Privacy Policy.

4. User Content

You may post text, images, videos, and other content (“User Content”).

You retain ownership of your User Content. However, by posting it, you grant Owting a non-exclusive, worldwide, royalty-free license to host, use, display, reproduce, modify, and distribute your content solely for operating and improving the Service.

You are solely responsible for your content. You may not post content that:

  • Is illegal, defamatory, obscene, or harmful

  • Infringes intellectual property or privacy rights

  • Harasses, threatens, or exploits others

  • Contains spam or fraudulent activity

We may remove content that violates these Terms.

5. Child Safety & Zero-Tolerance Policy

Owting has a zero-tolerance policy for child sexual abuse and exploitation (CSAE), including child sexual abuse material (CSAM).

Users may not upload, share, request, or distribute:

  • Sexual content involving minors

  • Child sexual abuse material (CSAM)

  • Content that exploits or endangers minors

  • Attempts to groom or solicit minors

Violations will result in immediate content removal and permanent account termination. Owting may report suspected illegal activity to law enforcement and cooperate fully with investigations.

If you encounter content or behavior involving child exploitation, report it immediately using in-app reporting tools or by emailing support@owting.com.

6. Acceptable Use

You agree not to:

  • Use Owting for unlawful purposes

  • Harass, stalk, or harm other users

  • Impersonate others

  • Attempt to hack, disrupt, or interfere with the Service

  • Scrape, copy, or reverse engineer the platform

Owting is designed to facilitate real-world connections. You are responsible for your interactions with other users.

7. Safety & Assumption of Risk

You understand that Owting facilitates real-world interactions. We do not conduct background checks on users and make no guarantees regarding user behavior.

You assume all risk associated with meeting or interacting with other users, both online and offline.

8. Intellectual Property

All platform content, branding, software, and materials (excluding User Content) are owned by Owting or its licensors and are protected by intellectual property laws.

You may not copy, distribute, modify, or exploit any part of the Service without written permission.

9. Disclaimers

The Service is provided “as is” and “as available.”

We do not guarantee:

  • Continuous availability

  • Error-free operation

  • That the Service will meet your expectations

To the fullest extent permitted by law, we disclaim all warranties.

10. Limitation of Liability

To the maximum extent permitted by law, Owting and its affiliates will not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of data, profits, or opportunities

  • Damages arising from user interactions

Our total liability will not exceed the greater of $100 or the amount you paid to us in the past 12 months.

11. Indemnification

You agree to defend and indemnify Owting from any claims, damages, or expenses arising from:

  • Your use of the Service

  • Your User Content

  • Your violation of these Terms

12. Termination

We may suspend or terminate your account at any time if you violate these Terms or if we discontinue the Service.

You may delete your account at any time.

13. Dispute Resolution

Any dispute arising from these Terms will be resolved through binding arbitration, except where prohibited by law.

You waive the right to participate in class actions or jury trials.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
